Rental Agreement

GENERAL

By booking a stay at Bellfire this is deemed to be a contract entered into between Bellfire, also referred to as “we”, “us”, “the Host”, “the Owner”, together with the associated possessive pronouns, and the customer who is referred to as “the Guest”, “they”, “them”, and the associated possessive pronouns.


BOOKING AND RESERVATION POLICIES

Guests who make bookings at Bellfire must be aged 21 years or older. The Guest who makes the booking agrees to these Rental Agreements on behalf of all members of their party, binding them jointly and severally to the terms herein. You agree that you have read this rental agreement in full, the property descriptions, and have asked questions you need answered prior to making your reservation. We want to ensure that you know what to expect, and we strive to create a space where you can have a great experience!

Once a booking is confirmed the Guest is liable for payment of the balance of the total cost, along with any additional charges incurred during their stay. Non-payment of the balance of the total cost will be treated as a cancellation of the Guest’s stay.

We reserve the right to refuse a booking without explanation.


The accommodations are as follows:

Bellfire Birdhouse: one guest or two guests only, in one Queen size bed
Bellfire Cosmic Nomad: one guest, two, guests, three guests or four guests in two Queen size beds.
Bellfire Tipi: one guest or two guests in two single beds
Bellfire Forest Belle: one guest or two guests in one Queen size bed.

The total number of individuals staying on the Premises during the Lease Term shall be a total of confirmed on the booking reservation. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host.

Parents: you are responsible for your children. This includes ensuring they understand the rules of the space, including how to use the composting toilets. Please supervise your children. Please keep you children within your space’s indoor/outdoor area and do not let them go up to or into other lodgings or spaces. We are not liable for any injury or damage.

Group bookings are accepted entirely at our discretion.

OCCUPANCY


LEASE TERM

The Guest shall be allowed to occupy the Premises starting check-in date mentioned on your booking confirmation and guest portal from check-in time and ending check-out date and check-out time mentioned on your booking confirmation email.  (“Lease Term”). Check in and check out times are firm due to needing to clean thoroughly between each guest.


DAMAGE, LOSS & CLEANING

The guest agrees to leave the accommodation in tidy condition and follow all house rules provided on arrival.
The Guest must remove all food items and belongings when they leave. Any food items found to be left within the accommodation after the Guest’s stay will be disposed of immediately. Any belongings found to be left behind in the accommodation after the Guest’s stay must be claimed by the Guest within 30 days of the Guest’s departure. In such cases the Guest will be charged the cost of postage and packing plus a $10 administrative fee to have them returned. After 30 days any such unclaimed items will be disposed of. The Guest must follow Bellfire’s instructions about waste and recycling. If the accommodation is not left in an acceptable condition, incurring extra cleaning above and beyond the level which is expected, this will be charged at $20 per individual staff hour. Bellfire reserves the right to deduct this payment using the Guest’s payment details or to invoice the Guest following their stay.


LIABILITY

During their stay it is the Guest's responsibility to close windows and lock their accommodation when they are not on site. Canvas camps that do not lock, we recommend storing your valuables in your car. Bellfire is not responsible for any damage to, the safety of or the loss of the Guest’s personal property while it is on site at Bellfire.
Bellfire is not responsible for any damage, illness or injury caused by use of the accommodation and any amenities; such use is at the Guest’s own risk. Bellfire has no liability for any death or personal injury to Guest/s on site.
The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for themselves and their guests if such coverage is desired.


ACTS OF NATURE

When you are staying in any of our spaces, there is always a risk of inclement weather or acts of nature (such as trees falling, etc.). We do our very best to keep our spaces safe but know that you are taking a risk when staying in these alternative spaces, particularly the glamping tents.


CANCELLATION POLICY

If a stay is cancelled up to 30 days prior to check-in date, a full refund will be given to the guest, minus the credit card processing fees. If a stay is cancelled 14 or up to 29 days prior to arrival, a 50% refund will be given to the guest, minus the credit card processing fees. If a stay is cancelled 14 or less days prior to check-in, no refund will be given to the guest. We reserve the right to refuse any booking or cancel any bookings, subject to refunding any sums you have paid, without further liability on our behalf. We cannot accept responsibility or pay any compensation where the provision of the holiday is prevented or affected by reason of circumstances which amount to “force majeure”. These include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic, pandemic and all similar situations beyond our control. We recommend that our guests purchase travel insurance if you would like to cover your reservation.


DATE ALTERATIONS AND RESCHEDULE

Please contact us if you need to alter your reservation dates, we will do our best to accommodate all reasonable requests. Please note that no alteration requests will be processed within 14 days of the check-in date.


SITE REGULATIONS

Guests at Bellfire must keep to the site rules listed here, behaving in a considerate, respectful, and safe manner to all people and animals onsite:
-        Quiet hours begin at 10:00 PM each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.
-           PETS - We are pet friendly. If you plan on bringing your pet(s) - (maximum of 2 per stay, dogs only), please add the pet fee to your reservation.
-        SMOKING POLICY. Absolutely no smoking inside the dwellings
-        Smoking is permitted in your camp and outside areas. Guests must dispose of any cigarette waste in the garbage bin provided at each site.
-        Do not leave bonfires unattended or burning before leaving the site or going to bed.
-        Do not leave indoor heaters on before leaving the site or going to bed.
Bellfire was created as a place for guests to come to for rest, to give the opportunity to switch off and immerse themselves in this peaceful place. This is why we do not permit people to use their stay at Bellfire as photo opportunities for endorsing any businesses, products, or for commercial or promotional use without prior written agreement from the host.
-        The Guest shall use the Premises for recreational use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.
-        Please do not enter any other dwellings on the property without permission. Please respect the privacy other guests.
-        Please turn off all lights, lanterns, fans, heaters, stoves when you leave for an outing or prior to checking out.
-        No fireworks, firearms or confetti cannons are allowed on the property, no exceptions.
-        Please take off outdoor shoes when inside
-        Leave no trace.
If any of these site regulations are breached, we reserve the right to take a fine of $200 which will be levied to cover the cost of additional deep cleaning, repair or replacement, and redecoration.


WILDLIFE, NATURE, AND BUGS

A big part of the Bellfire experience is being close to nature. This means there will be wildlife and acts of nature that we cannot control. We have seen bears, snakes, deer, chipmunks, field mice, wild turkeys & foxes. Please do not leave trash outside and please do not leave food inside the tents, to prevent unwanted animal guests. Your camp is located in a natural wildlife habitat. Bugs and critters make up our natural ecosystem and come with the territory. We do everything possible to keep them outside, by thoroughly cleaning the space between guests but some still wander in.


COMPLAINTS

We endeavor to ensure that Guests at Bellfire are given a positive experience, as evidenced by both our Guests’ good reviews and the number of repeat bookings we receive. We also recognize that on occasion things go wrong. In such circumstances, it is the responsibility of the Guest to make any such problem known to us immediately it becomes apparent, thereby giving us the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained. We will make every endeavor to rectify any identified problems as soon as is reasonably possible. Please note that essential maintenance activities may be carried out on, around or in the accommodation during your stay. We reserve the right to enter the accommodation to investigate any concerns by Guests as to disturbances or care of the property. If Guests deny us the opportunity to investigate complaints during their stay, the Guest will waive all rights in this matter. If Bellfire’s Site Regulations are breached, we may ask Guests to terminate their stay with immediate effect and without a refund.


MISCELLANEOUS

Whilst every care is taken to provide a true and accurate description of the property on our website, in marketing material and in email communications, alterations and updates will be made throughout Bellfire over time. The Guest accepts that no refunds are available for any such discrepancies.
We reserve the right to enter the accommodation in the event of an emergency or remedial repair work being required.
We are entitled to ask the Guest to leave the property without any refund if, in our opinion, the behavior of the Guest and / or their party is in breach of the conditions stipulated here.


ATTORNEY’S FEES

The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.


GOVERNING LAW

This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.
